1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Endur data platform (the "Platform"), available at app.endur.earth, operated by Endur Inc. ("we", "us", or "our"). By using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

2. Platform Overview

The Platform provides access to ocean and environmental datasets aggregated from various third-party data providers ("Data Providers"). Each dataset may be subject to its own license terms, which you must review and comply with when using the data.

3. Use of the Platform

You may use the Platform to browse, explore, analyze, and download datasets, subject to the license terms applied by the original Data Provider. Unless otherwise stated by the applicable license:

• You may use the data with subject to the terms of the original license only;
• You must give appropriate attribution to the source and licensing terms;
• You may not sublicense, resell, or redistribute the data in ways not permitted by the original license;
• Use of the data is at your own risk.

4. Your Responsibilities

• You are responsible for ensuring that your use of the data complies with all applicable licenses and laws.
• You may not upload or share data through the Platform unless you have the rights to do so.
• You must not misuse the Platform (e.g., attempt unauthorized access, distribute malware, or extract data in bulk outside permitted use).
• If you are using the Platform on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

5. Data Licensing and Attribution

Each dataset may include metadata describing its origin, license, and permitted uses. You agree to:

• Respect any license restrictions or requirements from the Data Provider;
• Provide attribution as required (e.g., name of Data Provider, title of dataset, license type);
• Clearly indicate any changes you make to the data.

If a dataset includes a Creative Commons license (e.g., CC BY 4.0), you are bound by the terms of that license. In cases of conflict between these Terms and a dataset's license, the dataset license governs your use of that data.

6. Intellectual Property

Endur Inc. owns all rights to the Platform interface, codebase, and original content. We do not claim ownership over datasets provided by third parties. Trademarks, logos, and data sources are the property of their respective owners.

7. No Warranties

All data is provided "as is " We do not guarantee accuracy, completeness, or fitness for any particular purpose. We disclaim all warranties, express or implied, to the maximum extent permitted by law.

8. Limitation of Liability

To the fullest extent allowed by law, Endur Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Platform or any datasets accessed through it.

9. Changes to the Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.

10. Termination

We may suspend or terminate your access to the Platform at any time if we believe you have violated these Terms or any applicable data license. You may stop using the Platform at any time.

11. Governing Law

These Terms are governed by the laws of Delaware. Any disputes shall be resolved in the courts of Delaware, unless otherwise required by law.
